Air Booking Terms and Conditions

The following Terms & Conditions apply solely to all bookings made and issued with ROYAL SCENIC Booking Engine. also knows as Royal Plus (Royal+). For information on other ROYAL SCENIC products, kindly refer to the appropriate sections with details listed in the respective pages of our Web site.
By making a reservation on this Website, you agree to adhere to the Rules, Terms and Conditions applicable. It is important to read the rules for the specific fares that you intend to book by clicking on the Rules button under the Fare Basis column on the display screen.

General Introduction

ROYAL SCENIC shall not be liable for failure of travel service suppliers, including but not limited to airlines, hotels, cruise lines, railroads, car rental agencies, tour operators and consolidators to perform the services offered by such suppliers. ROYAL SCENIC, in providing travel management services, does not guarantee or insure the services to be provided by any supplier, the financial position of such suppliers or the reimbursement to you from any loss experienced as a result of the financial condition of such supplier. In the event that a supplier defaults prior to providing the service to you for which payment has been made, the sole recourse for refund shall be with the defaulting supplier, from insurance covering such defaults if any or from other responsible third party unless such was caused by ROYAL SCENIC.

In those situations, in which a supplier defaults prior to providing services you may pursue any recourse against the supplier for refund, which may be permitted by law or statute. ROYAL SCENIC warrants that it provides the highest standards of service in the trade and will use appropriate care in selecting suppliers to protect you from such default.

Except as expressly stated herein, ROYAL SCENIC assumes no responsibility for actions relating to travel services beyond the control of ROYAL SCENIC or its employees. ROYAL SCENIC is not responsible or liable for any act, error, omission, injury, loss, accident, damage, delay, nonperformance, irregularity, or any consequence thereof, which may be occasioned through neglect, or default or any other act or inaction of any supplier of Travel products. ROYAL SCENIC shall not be liable for any fluctuation in price or change in schedule or equipment or accommodations for any travel service, which occurs after payment for such service.

ROYAL SCENIC acts as a service bureau that provides value added service to Travel Agents and its customer passengers. ROYAL SCENIC has no control over and assumes no liability for the actions of the suppliers from whom it obtains Travel products. (ROYAL SCENIC may include a service fee in the fare quoted to you. Our service fee may vary depending on a number of factors, including but not limited to fare type, market conditions, the amount of savings we pass on to you, the time and effort we spend on fulfilling the tickets you request at the best prices, upgrades applied if any, your form of payment, etc.)

Once tickets have been issued there may be a penalty involved for cancellations and/or refunds. We do not have control over printed prices on the tickets, although most tickets may have BT (Bulk fare) printed on them, some may have a specific value on them, which may be different (lower or higher) than the fare collected.

General Terms & Conditions

PRICES
All prices listed are quoted in Canadian Dollars unless otherwise specified. RSH Travel Inc. (Royal Scenic) reserves the right to change prices in the event of any price revision by the applicable supplier that is beyond the control of Royal Scenic. This includes, but is not limited to fuel surcharge due to the price of fuel and/or currency exchange rate fluctuations.

The prices listed supersede any prices published in any previous or current Royal Scenic Brochure. The pricing in the brochure is current at the time of printing and subject to change thereafter without notice. Please contact your preferred travel agent for the most current offer or consult update pricing here at www.royalscenic.com.

RESERVATIONS
Please contact your travel agent to make reservations. We recommend that tour reservations be made at least 60 days prior to the scheduled departure date for all destinations. A nonrefundable deposit of $350.00 is required at the time of booking.  The balance of  payment is due 60 days prior to the scheduled departure date. For any booking made within 60 days of departure, full payment is required.

We reserve the right to cancel the booking if full payment is not received by the due date and the applicable cancellation penalties will apply.

CANCELLATION CHARGES FOR TOUR PACKAGES
* 60 days or more prior to scheduled departure – $350.00
* 59 – 45 days prior to scheduled departure – 25% of total tour cost
* 44 – 31 days prior to scheduled departure – 50% of total tour cost
* 30 – 0 days prior to scheduled departure – 100% of total tour cost

General deposit and cancellation policy listed above are based on air & land inclusive packages described on the website.  In the case of changes (including seat sale, special promotion or price increase) as imposed by the air carrier or the land supplier, a different deposit requirement and/ or cancellation policy might apply based on each individual booking. We will advise you accordingly at the time of booking request.

REFUNDS
All claims for refunds must be made in writing through the travel agent that purchased the tour.  No refund is allowed for unused tour services. All claims for refund must be presented to Royal Scenic within 21 days after cancellation of the tour. No refund or adjustment will be provided for portions unused.

INSURANCE
We offer travel insurance for trip cancellation, hospital, medical, baggage and trip delay due to weather, mechanical problems or schedule change. Insurance must be purchased at time of booking.

DESCRIPTION OF SERVICES
The brochure has been written to provide a complete and accurate description of the product and travel service offered. Occasionally, changes may occur and every effort will be made by Royal Scenic to provide prompt advice to our travel agency partner in advance. Travelers should be aware that there may be different living standards and conditions with respect to services and accommodations. Similarly, each country has unique features, which differ from what Canadians are familiar with, including weather, food and customs etc. This may be less that a traveler may expect from Canadian standards.

Royal Scenic is not responsible for any loss, damage, injury or inconvenience resulting from different living standards or variations.

TOUR PACKAGE INCLUDES
All Asia & The World packages include domestic economy airfare, where specified, accommodation as listed or comparable, sightseeing and meals as specified in the itinerary, all hotel and airport transfers and document wallet. Flight bag is provided depending on the type and duration of the booked package.Taxes and surcharges to hotels are included for the duration of the stay. AsiaRibbean, Royal Cityscapes/ Golf/ Spa Collection are land only packages excluding airfare. If required, please enquire for best airfare prices at the time of booking request.

Insurance, airport taxes, transportation of excess baggage, laundry, liquor, use of telephone, gratuities for local guides/drivers/tour director visa fees and any item not mentioned as specified are excluded.

TAXES AND SERVICE CHARGES
All travel services are subject to taxes and service charges. The exact taxes and amounts vary by destination, season and package selected.
For Credit Card payments, an additional 3% Merchant Fee on VISA/Mastercard and 4% on American Express will be applied to the total charge on our tour products. This fee is levied by the bank merchant and is non-refundable even if the booking is cancelled at a later date.
These charges are subject to change.

HOTEL
Rooms are provided as specified and meet the quality standards applied by Royal Scenic. Royal Scenic reserves the right to substitute hotels for a similar category should it become necessary due to circumstances beyond the company’s control.

BAGGAGE
For Transpacific Economy class the free baggage allowance is either one or two suitcases, depending on the air carrier’s baggage policy. The maximum weight per bag is 23kg (50lb) and the total dimensions cannot exceed 158cm (62in). For domestic flights within China the baggage allowance is restricted to one piece per passenger with a maximum weight of 20kg (44lb). Different airlines may have different baggage allowances. We strongly advise that you reconfirm the baggage allowance with your carrier prior to departure. The owner assumes full responsibility for their bags throughout the tour. Royal Scenic is not responsible for loss, theft or damage to any traveler’s personal belongings however caused. Royal Scenic highly recommends all travelers purchase travel insurance.

TRAVEL DOCUMENTS
Royal Scenic advises that all travel documents are the responsibility of the traveler.  Passports must be valid 6 months after the end of the tour for most countries in Asia.  In the case of China, Royal Scenic will secure the visa entry into the country for a minimal fee.

Royal Scenic will forward traveler applications to the applicable consulate office for their approval.  Royal Scenic cannot guarantee the acceptance of the visa application. If denied, a full refund of the tour will be made. Visa fee is non-refundable.

HEALTH
Vaccinations may be required. Please contact your local and destination Public Health Agency for detials and requirements. Canadian style medical attention is available in most parts of Asia.

LIABILITY
RSH Travel Inc. (hereinafter referred to as “the company”), makes arrangements with suppliers such as airlines, coach companies, transfer operators,hotel and other independent parties as an agent upon the condition that the company is not liable or responsible for any claims, losses, damages, cost or expenses arising out of personal injury, accidents or death, loss, damage delay, inconvenience, loss of enjoyment, upset, disappointment, distress and frustration, whether physical or mental, resulting from the following:

  • The act of omission of any party other than Royal Scenic or its employees;
  • Sickness, theft, labour disputes, mechanical breakdown, quarantine, government actions, weather, or any other cause beyond our direct control;
  • Your failure to obtain the documentation required for your trip such as passports, visas, and certificates (in which case you will also not be entitled to any refund);
  • Your failure to follow instructions including but not limited to airport departure times, baggage handling, and check-in and check-out times;
  • Cancellation or change for any reason in the travel services offered, we reserve the right to cancel or change the travel services at our discretion, but we will try to substitute comparable services. If we must completely cancel your reservation.  Royal Scenic  liability will be limited to a refund of all monies paid;
  • A full refund, however, will not be honoured in situations where travel must be cancelled by Royal Scenic Holiday for reasons which are beyond its control (force majeure situations: weather, riots, etc.) and where Royal Scenic Holiday contractual obligations with its suppliers does not allow it to obtain reimbursement of the sums paid to the supplier on behalf of the customer.

Royal Scenic takes great care in selecting the suppliers of services. The suppliers are independent parties over which we have no direct control. Supplier’s liability may be limited by law, tariffs, or conditions. It is important travelers read and understand the limitations of liability set forth in supplier documentation.

Reservation of the tour package in this brochure confirms you have read, understood and agreed to each and all of the above conditions and limits of responsibility.

No person, other than an authorized representative of the company by a document in writing, is authorized to vary, add or waive any term or condition in this brochure, including any term or condition set forth in the proceeding provisions.

GENERAL NOTICE
We do our best to give your customers an enjoyable trouble-free holiday but occasionally even the best-laid plans can go wrong. If your customers have a problem during their holiday, they are required to immediately inform the relevant supplier (e.g. hotel) who will endeavour to put things right during the course of the stay.

Hotels and suppliers are more likely to help us resolve matters or achieve refunds if your passengers report any problems during their stay. We cannot accept liability in respect of any complaint, which is not reported to us during the passenger stay, or within 21 days of the completion of services.

If the complaint is not resolved locally, please follow up this within 21 days of the completion of services and provide us with your original booking reference number and all other relevant information. Royal Scenic will:

a. acknowledge complaints in writing within 3 days
b. investigate all complaints arising and to respond within 14 days of receipt from all relevant information from you
c. do our utmost to ensure that the cause of the complaint does not repeat and to keep our suppliers informed in order to take the necessary steps to provide the best service to our clients

Royal Scenic does not manage, control or operate any hotel or any other supplier of services. Royal Scenic and / or its agents and suppliers, give notice that all vouchers issued for accommodation are made by them as agents for its clients, upon express condition that they assume no responsibility for any injury, damage, loss, accident, delay or irregularity, which may occur either by reason or defect or through the acts of any hotel proprietor or employee or company or person engaged in providing the accommodation arrangements.

Royal Scenic Hotel Booking – Terms & Conditions

The following Terms & Conditions apply solely to Royal Scenic Hotel Bookings.  For information on other Royal Scenic products, kindly refer to the appropriate sections with details listed in other applicable pages of our web site.

PRICES
All prices quoted are net-non commissionable in Canadian dollars and include local taxes & hotel service charges except where indicated. Breakfast/ supplement is generally not included except some hotels in Europe unless indicated otherwise. We reserve the right to amend all rates quoted in the event of any changes in Government taxes. Any such charges will affect new and existing bookings. Optional gratuities for service providers such as bellman, maid or attendants are not included. All rates are subject to change without notice. Published prices on our Hotel Booking Engine are the best rates we have negotiated and will be guaranteed once the booking is made, however, a hotel supplier may occasionally advertise alternate rates/ offers which could be different from our published prices.

HOTEL RESERVATIONS
When a hotel is confirmed, it becomes a definite booking and we do not require a reconfirmation from the passenger or the booking agency. It is the booking agent’s responsibility to cancel this booking with us to avoid extra charges for changes or no show as shown below. The child policy is valid for one child sharing with 2 full paying adults. Please indicate the age of the accompanying child in the appropriate fields.

Royal Scenic confirms all bookings with a reference number. This must be used in all future correspondence.

CANCELLATIONS OR CHANGES
Cancelled / revised bookings are subject to the following fees after payment is processed and/or vouchers issued:

15 or more days prior to departure – $25 per booking
7 to 14 days prior to departure – One night charge
Within 7 days prior to departure – No refunds applicable
ALL CHANGES to paid bookings are subject to a $25 fee.

No refund is allowed for any unused portion of the stay.

PAYMENTS
Full payment must be made at the same moment that your reservation is made, following the instructions and requirements indicated on our web site:
• Payment by credit card only
• Card holder must be one of the guests
Please note that a 3% merchant fee will be deducted from our rebate to you on the mark up amount (the difference of the actual net price sold to you and the amount billed on credit card of the card holder).

In an effort to minimize the chances of credit card fraud, Royal Scenic’s standard policy has always been to require a signed copy of the UCCCF (Universal Credit Card Charge Form) at all times and in all cases. Since you have chosen to make your transaction via our website, we remind you that when you provide us with a credit card as form of payment, it is your responsibility to have the cardholder’s signature on file, since it will be required in the event of a charge back.

If your agency is unable to provide us with the cardholder’s signature in the fashion required by the credit card company used, your agency will be held liable for all charges relating to charge backs or fraudulent use. By applying a credit card as form of payment in our website, you confirm that you are in agreement of these terms and conditions.

IN CASE OF CREDIT CARD CHARGEBACKS, THE AGENT WILL BE CHARGED A HANDLING FEE OF CAD80.00 PER RESERVATION MADE PLUS 3% SERVICE FEE ON THE TOTAL AMOUNT OF THE RESERVATION.

TRAVEL DOCUMENTS/CHARGES
All travelers are responsible for obtaining valid travel documents, complying with customs, regulations, obtaining insurance, and for making themselves aware of and complying with the laws of place to which they are traveling. Royal Scenic is not responsible for any immigration charges, fees or penalties that may be imposed by government agency or entity.

GENERAL NOTICE
Royal Scenic reserves the right to offer the best available alternative accommodation of same and / or higher category and price, should the confirmed space become unavailable due to circumstances beyond the control of Royal Scenic.

Rooms will be assigned upon arrival. Bedding type and special requests cannot be guaranteed and no refund will be made if ever the hotel is not able to fulfill the request(s) made. Bedding type and all special requests are at the discretion of the hotelier and will be allocated based on availability at check-in. Royal Scenic, will take no responsibility if hotels do not comply.

c. do our utmost to ensure that the cause of the complaint does not repeat and to keep our suppliers informed in order to take the necessary steps to provide the best service to our clients.

Royal Scenic does not manage, control or operate any hotel or any other supplier of services. Royal Scenic and / or its agents and suppliers, give notice that all vouchers issued for accommodation are made by them as agents for its clients, upon express condition that they assume no responsibility for any injury, damage, loss, accident, delay or irregularity, which may occur either by reason or defect or through the acts of any hotel proprietor or employee or company or person engaged in providing the accommodation arrangements.

Royal Scenic recommends that all passengers be required to purchase comprehensive travel insurance, including cancellation, medical and air evacuation prior to departure or during the travel period. Insurance purchase is available by calling us at Eastern Canada 1-888-302-888 or Western Canada 1-877-736-6028.

FORCE MAJEURE
Any failure to perform, delay, liability or damage shall be excused and Royal Scenic shall not be held responsible for the consequences of Acts of God, labor disputes, civil commotions, fire, weather conditions, theft, unavoidable accidents, war, acts of state or agencies thereof, or any other circumstance beyond the control of Royal Scenic. Royal Scenic shall not be liable should it be required to change an itinerary or individual booking, hotel accommodation or other services necessary for the safety and continuation of any tour or passenger or due to unforeseen circumstances beyond the control of Royal Scenic. Royal Scenic reserves the right to modify or change any published rate where changes or modifications have been made and are required by any entities beyond Royal Scenic’s ownership or control. Royal Scenic shall not be held responsible for any error, omission, or deletion of the material on the Booking Engine by Royal Scenic or any third party.

Hotel reservations made here confirm that you, the booking agent, has accepted, read, agreed and understood to each and all of the above conditions and limits of responsibility.
